Landlord/Tenant Issues

 Jim has years of experience dealing with landlord tenant issues through negotiation, mediation and trial disputes.  Among other issues, he has address constructive eviction, illegal units and tenant harassment.  

Jim has helped tenants address the below issues with confrontational and combative landlords that infringe on a tenants right to a habitable dwelling:


  • Safe source of heating systems capable of maintaining reasonable temperature;
  • Proper weatherproofing of windows, exterior walls, and roofs;
  • Hot and cold running water;
  • Reasonable plumbing and gas fixtures;
  • Building free of mold, hazardous lead and bed bugs;
  • Notification of potential bedbug, asbestos, toxic tort and flood zone hazards;
  • Reasonable access to safe stairs and common areas; and 
  • Working electrical plugs and phone jacks; 
  • Water leaks;
  • Landlord or landlord agent entry without 24 hours notice.


Be Aware:


  • Your landlord cannot retaliate against you for requesting repairs.
  • Dwellings with rodents generally are not habitable;
  • Local Rent Ordinances provide an added layer of protection for tenants.


Eviction

Your landlord cannot evict you without just cause. If your landlord illegally evicts you or retaliates against you because you pursue your rights against your landlord for a habitable home, your landlord may be subject to liability for any damages to you caused by his/her retaliation actions. Retaliation includes unlawful rent increases, reduction in your tenant services and attempting to evict you. You may bring suit while still in the unit or after leaving the unit or being forced out of your unit by your landlord.
